NHESA Terms and Conditions


1. ACCEPTANCE OF TERMS
You agree that you are only authorized to visit, view and retain a single copy of pages of the Site solely for your own individual use, and that you shall not duplicate, download, publish, modify or otherwise distribute any material on this site for any purpose other than for your own individual use unless otherwise specifically authorized in writing by National Health and Exercise Science Association (NHESA). We post legal notices and various credits on pages of the Site, which may not be removed, even in your permitted copy. You shall not remove these notices or credits or any additional information contained along with the notices and credits. You may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of NHESA and our affiliates without express written consent. You may not use any meta tags or any other "hidden text" utilizing NHESA name or trademarks without the express written consent of NHESA. Any unauthorized use terminates the permission or license granted by NHESA. You are granted a limited, revocable, and nonexclusive right to create a hyperlink to the home page of NHESA. so long as the link does not portray NHESA its affiliates, or their products or services in a false, misleading, derogatory, or otherwise offensive matter. You may not use any NHESA logo or other proprietary graphic or trademark as part of the link without express written permission.


2. RIGHTS OF PRIVACY
You may visit www.nhesa.orgwithout revealing any information about yourself to us. There are portions of the website where you can voluntarily submit personal information to us. The information collected is only used for business purposes between NHESA and the person submitting the information. Information collected from you will be used to provide certain information that you request to receive. NHESA does not share your personal information with any third parties, nor do we sell or rent any information collected from our website.
Acceptable Use
The following is deemed acceptable use of www.nhesa.org:
Business Purposes– You may use the NHESA website(s) for the purpose of performing business with NHESA. This includes browsing the website in search of services offered, pricing information, research, obtaining contact information, and exchanging personal information with NHESA, and its employees.
The following are deemed unacceptable use of www.nhesa.org and constitute a violation of this Agreement:
Uses that violate the privacy and security of website visitors – Do not attempt to obtain access to restricted areas of the website, attempt to obtain personal information of website visitors, or obtain users personal information in an attempt to make it publicly available.
Uses that cause harm to NHESA equipment or website content – Do not attempt to obtain unauthorized access that would cause harm to the content of the site, or the equipment it is hosted on. In short, don’t hack us!
Uses of commercial advertisement –Do not use the NHESA website to advertise a product unless authorized by NHESA.
 

3. OUR SERVICE
NHESA provides you the customer with access to a collection of technical documentation, and research material relating to the health and exercises sciences (the "Service"). Unless explicitly stated otherwise, any new features or improvements to the current Service shall be subject to this Agreement. You understand and agree that this Service is provided to you "AS-IS" and that NHESA assumes no responsibility.


4. OWNERSHIP AND CONTENT AND MATERIALS.
All content included on this site including but not limited to, text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of NHESA and protected by United Statesand international copyright laws. The compilation of all content on this site is the exclusive property of NHESA and protected by U.S.and international copyright laws. Except to the minimum extent expressly permitted under copyright law, no copying or exploitation of material from the Site is permitted without the express prior written permission of NHESA and any other applicable copyright owner. To seek such permission, you may write NHESA, at 3701 Flintridge Court, Brookeville, MD 20833. You may not resell the services or any thereof. All rights not expressly granted hereunder are expressly reserved to NHESA.


5. INTELLECTUAL PROPERTY RIGHTS
Using the Services you agree not to transmit material that is copyrighted, unless you are the copyright owner or material that infringes on any Intellectual Property Rights of others.


6. TRADEMARK
NHESA and other marks indicated on our site are registered trademarks of The National Health and Exercise Science Association, or its subsidiaries, in the United Statesand other countries. All www.nhesa.org graphics, logos, page headers, button icons, scripts, and service names are trademarks of NHESA or its subsidiaries. NHESA trademarks may not be used in connection with any product or service that is not NHESA in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits NHESA.  All other trademarks not owned by NHESA or its subsidiaries that appear on this site are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by NHESA or its subsidiaries.


7. LIMITATION OF LIABILITY
You expressly agree, and understand that NHESA shall not be liable for any damages direct or indirectly, including but not limited to, loss of profits, data, or other intangible, relating to the use of the service.


8. INDEMNITY
You agree to release, and hold NHESA and its contractors, agents, affiliates, officers, or other partners, and employees, harmless from any and all liabilities, claims or demand, including reasonable attorneys' fees, made by any third party due to or arising out use of the Service. If NHESA is threatened with a suit by a third party, we may seek written assurance from you concerning your promise to indemnify us. Failure to provide that assurance may be considered by us as a breach of this Agreement.


9. GOVERNING LAW
This Agreement is entered into in the state of Maryland and is written in accordance with the laws of Maryland.  Each party to this Agreement submits to the exclusive jurisdiction of the State and Federal Courts having jurisdiction in the County of Montgomery located in the state of Maryland, and waives any jurisdictional objections to such courts. The prevailing party will be entitled to cost and attorney fees associated with any action used to enforce this Agreement. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or the Agreement must be filed within one (1) year after such claim or cause of action arose or be forever barred.


10. GENERAL INFORMATION
The Agreement constitutes the entire agreement between you and NHESA and governs your use of the Service, superceding any prior agreements between you and NHESA. You also may be subject to additional terms and conditions that may apply when you use affiliate services, third-party content or third-party software.

11. VIOLATIONS
If you find any violations of the Agreement please report it to our Customer Service department at info@nhesa.org
